Vietnam plywood is listed in the new rules of origin!

In the first eight months, Vietnam’s exports to Canada increased by 31.3% year-on-year, to the United States by 25.3%, to Mexico by 20.9%, and to Japan by 9.9%;

Export to South Korea increased by 5.3%; export to ASEAN increased by 3.7%; export to Russia increased by 14.2%; export to New Zealand increased by 12.8%.

At present, Vietnam has signed two major free trade agreements, namely the Vietnam EU free trade agreement (evfta) and the trans Pacific Partnership Comprehensive and progress agreement (cptpp), which will enable Vietnam to enjoy more tariff preferences when exporting to Canada, Japan, Mexico, Peru, France, Germany and other markets. But these two free trade agreements also put forward higher requirements for Vietnam’s origin qualification.

On the other hand, Vietnam’s exports to the United States have increased significantly with the escalation of trade frictions between China and the United States, which has aroused the alarm of the United States. According to US government statistics, in the first five months of 2019, Vietnam’s exports of computers and electronic products to the US increased 71.6% year on year;

At the same time, exports of electronic products, computers, machinery and other equipment from China to Vietnam surged compared with the same period in 2018. The United States has put pressure on Vietnam and repeatedly urged Vietnam to strictly inspect the export of “washing place”.

Therefore, since this year, Vietnam has repeatedly adjusted its rules on the confirmation of import and export origin, and the latest rules will come into effect on October 21.

Previously, the draft “made in Vietnam” (origin) standard issued by the Ministry of industry and trade of Vietnam stipulated that:

The place of origin must be indicated on the commodity label. If a certain commodity is purely produced in Vietnam or is completely produced in Vietnam, it can be marked “made in Vietnam”.

If the goods are made in the final processing stage of Vietnam, they must meet the requirements of relevant commodity code (HS) conversion regulations and the domestic added value ratio of more than 30% before they can be marked “made in Vietnam”. ‍

Recently, the Ministry of finance of Vietnam issued announcement No. 62 / 2019 / tt-btc to supplement and amend Announcement No. 38 / 2018 / tt-btc to confirm the origin of import and export goods. Proclamation No. 62 / 2019 / tt-btc shall enter into force on October 21, 2019.

Announcement No. 62 / 2019 / tt-btc amended many origin issues. Specifically, the HS code column on the certificate of origin is different from that on the import declaration. Item 6 h of Article 15 is supplemented and amended as follows:

If the HS code column on the certificate of origin is different from that on the import declaration, and the description of the goods on the certificate of origin is different from that on the import declaration and the actual goods, but the customs authority has the basis to confirm that the goods belong to the tariff number column on the import declaration, and the supplementary import declaration meets the origin standard, the goods can be accepted Local certification documents.

If the HS code column on the certificate of origin is different from that on the import declaration, and the description of the goods on the certificate of origin is different from that on the import declaration and the actual goods, and the customs authority has the basis to confirm that the imported goods are not the goods on the certificate of origin, the customs authority shall reject the goods on the certificate of origin, and in accordance with this corporation The provisions of item 2 of Article 22 shall be notified to the electronic data processing system of the customs.

If the HS code on the certificate of origin is different from the tariff number on the import declaration, and the description of the goods on the certificate of origin and the import declaration is consistent with the description of the goods actually imported, if the customs unit has no basis to confirm that the goods on the tariff number on the import declaration meet one of the origin standards stipulated in the No. 31 / 2018 / nd-cp agreement, the customs unit shall comply with this announcement Article 19 and 21. ‍

In addition, Announcement No. 62 / 2019 / tt-btc also supplemented the rejection of certificates of origin. Specifically, item 1 (d) of Article 22 is supplemented and amended as follows:

If the certificate of origin of the goods has been held at the time of handling the import formalities, but the customs declarer does not provide the certificate of origin number and date of issue, or does not hold the certificate of origin at the time of handling the import formalities, and the declarer does not apply for postponement of payment in accordance with the provisions of Article 5 of this proclamation on the import declaration form, the customs authority may refuse the certificate of origin in accordance with the provisions.

If the declarant applies for delaying the payment of the certificate of origin (as stipulated in Article 5 of this proclamation), but the declaration and payment can be supplemented only after the expiration of the time limit (as stipulated in Article 7), the customs authority may refuse the certificate of origin according to law. ‍

At present, on the official website of the Ministry of industry and trade of Vietnam, it can be found that since this period of time, Vietnamese officials have frequently updated the news about “origin washing”, which shows the importance they attach to it.
